How to notify about intellectual property rights infringements
MyDeal is committed to ensuring that products sold on its platform, and their product listings, do not infringe third party intellectual property rights. If you are a rights holder (or their authorised representative), you can notify us of products or listings you believe infringe your intellectual property rights by submitting this form to us.
If you are not a rights holder, and wish to report a product that you believe may infringe intellectual property rights, you can contact our Help Centre.
Complaints process
While we will take action where legitimate complaints are received, we do not mediate with sellers or rights holders in relation to any disputes. We will provide each party relevant contact details for one another to resolve any disputes that arise.
If we receive a complaint about a seller product which alleges intellectual property rights infringement, we will make an initial assessment of the complaint.
- If, based on the complaint, we believe there is a potential rights infringement, we will remove the product listing and notify both the seller and the rights holder that the product has been removed because of the complaint. We will then provide the seller the details of the complaint along with the contact details of the rights holder, and the rights holder with the seller contact email to contact them about the complaint.
- In all other circumstances we will notify the seller of the complaint and provide them with a copy of the rights holder’s details, unless we believe the complaint is unjustified or not related to breach of an intellectual property right.
We will not relist a removed product until we receive confirmation that the complaint has been resolved, but in all circumstances maintain the right to refuse listing of a product we believe may breach third party rights.
If a seller is found to have infringed third party rights or we believe they have breached this policy, we may take actions against their account including permanent removal of affected products or suspension or termination of their seller accounts. We may also seek further remedies open to us under our Seller Terms and Conditions.
Complaints we do not handle
We will not respond to, or take action against, complaints under this policy that are not related to a breach of intellectual property rights (i.e. copyright, trade mark, patent or registered design).
The examples of the types of complaints that we will not handle relate to:
- Product prices, for example, products selling below a brand’s recommended retail price;
- Exclusive distribution agreements. While brands, distributors and retailers may enter exclusive distribution agreements, breach of these agreements are generally not infringements of intellectual property rights, and MyDeal does not intervene in such contractual disputes.
